The environment should be non-judgmental and welcoming so that an alleged victim does not feel the need to hold back. The objective is to encourage the alleged victim to open up and share. This works to ensure the free flow of information from the alleged victim. But there is also one important negative that can result from this type of encouraging environment. The negative is that an environment that is all-accepting and all-believing lends itself to abuse. Case Results…  People v. D.R. (2015): Client was charged with sexual penetration of a minor and lewd acts with a minor on school grounds. The minor was Client’s girlfriend. Mr. Sabado negotiated the charges down to battery on school grounds, avoided sex offender registration and Client had no jail time. Client and girlfriend were later married.   People v. M.T. (2016): Client was charged with Penal Code Sections 261.5 and 288(a), both of which were potential felony convictions with prison time. Mr. Patel got Client charges reduced to a misdemeanor with no jail time by challenging the prosecutor on very questionable evidence.
